Please read these Terms of Use (“Terms”, “Terms of Service”) carefully before using our Website (kidsbeetv.com), the applications KidsBeeTV, Kids Learning by KidsBeeTV, tinyBee (“Apps”), or any other online services that link to this Terms (collectively the “Services” or “KidsBeeTV”) operated by Magikbee Lda (“us”, “we”, or “our”).

These terms are intended for parents and legal guardians, and users of the Services.

Your access to and use of the Services is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Services.

By accessing or using the Services you agree to be bound by these Terms. If you disagree with any part of the terms you may not be able to access the Services.

1. About the Apps

KidsBeeTV is a safe platform for kids that includes videos and learning games curated by teachers and education specialists, and that is aimed at children between 1 and 7 years old. Our Apps can be used on different devices: mobile phones, tablets, and smart TVs.

2. Privacy Policy

Your use of the Services is subject to our Privacy Policy. Please review our Privacy Policy, which also governs the Services and informs users of our data collection practices.

2.1. Controller Identification

All the data provided by you when using our Services will be processed by MAGIKBEE, LDA., a company with the VAT number PT513575820, whose registered address is 18A, 1º Frente, Rua de São Victor, Braga, Portugal.

3. Subscription

A subscription gives you unlimited access to all content available on KidsBeeTV as long as it is active: videos, games, educational activities, and weekly updates!

3.1. How it works on iOS

Payment will be charged to Apple Account at confirmation of purchase.
You can cancel online anytime – there is no cancellation fee.
You can use the subscription on any device registered with your Apple account.
Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current billing period.
Account will be charged for renewal within 24 hours prior to the end of the current billing period, and identify the cost of the renewal.
Subscriptions may be managed by the user and auto-renewal may be turned off by going to the user’s Account Settings on the Apple device after purchase.
Cancellation will not go into effect until the end of the billing cycle.
Any unused portion of a free trial period, if offered, will be forfeited when the user purchases a subscription, where applicable.

3.2. How it works on other platforms

Subscriptions are renewed weekly, monthly, or annually, depending on your subscription plan.
Your subscription is valid on any device registered to your KidsBeeTV account.
Your subscription is renewed automatically unless you disable automatic renewal at least 24 hours before the end of the current billing period.
The next payment will be charged 24 hours before the end of the current billing period.

In case you subscribed to KidsBeeTV through our Website or Huawei App Gallery, contact us to manage your subscription: support@magikbee.com.
The cost of the current subscription plan cannot be refunded, and service cannot be stopped in the middle of a billing period.
Any free trial, as applicable, will be interrupted when a paid subscription is purchased.
On Android, you may choose to access KidsBeeTV for free in an ad-based version. All ads are safe and kid-friendly.

4. Free Users or Users without a subscription

A limited part of the Services’ content will be made available to the free users of the Apps and unlocking any additional content will require registering for the subscription service. Android users have the additional option of accessing all content on a free version with kid-friendly advertisements (also called the “AVOD version”).

5. Account

When you create an account with us, you must provide us with information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Services.

Every account has one designated adult user (“adult user”, “parent” or “legal guardian”) who must be at least 18 years of age.

You are responsible for safeguarding the password that you use to access the Services and for any activities or actions under your password, whether your password is with our Services or a third-party service.

You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

6. Content

KidsBeeTV is a kids’ streaming service that also includes educational games. All the shows displayed are licensed for the purpose of distribution within the Apps and are age-appropriate.

KidsBeeTV reserves the right to modify the content available at any time without notice.

7. Intellectual Property

The Services and all their content, such as songs, videos, games, activities, stories, text, graphics, artwork, and the trademarks, logos, button icons, features, and functionality are and will remain the exclusive property of Magikbee Lda and its Licensing Partners. The Services are protected by copyright, and other laws of both Portugal and foreign countries. You agree not to copy, distribute, sell, store, or in any other re-use material from the Services, unless Magikbee gives you express written permission to do so.

8. DMCA Complaints

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible via our Services, please notify us, as set forth in the Digital Millennium Copyright Act of 1998 (“DMCA”). For your complaint to be valid under the DMCA, you must provide us in writing (i) an electronic or physical signature of a person authorized to act on behalf of the copyright owner, (ii) an identification of the copyrighted work that you claim has been infringed, (iii) an identification of the material that is claimed to be infringing and where it is located on the Services, (iv) information reasonably sufficient to permit us to contact you, such as your address, telephone number, and, e-mail address, (v) a statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or law; and (vi) a statement, made under penalty of perjury, that the above information is accurate, and that you are the copyright owner or are authorized to act on behalf of the owner. 9. Links To Other Web Sites

Our Services, in the areas meant for parents and legal guardians, may contain links to third-party websites or services that are not owned or controlled by Magikbee Lda. Magikbee Lda has no control over and assumes no responsibility for the content, privacy policies, or practices of any third-party websites or services.

You further acknowledge and agree that Magikbee Lda shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such web sites or services.

We highly advise you to read the terms and conditions and privacy policies of any third-party websites or services that you visit.

The areas of our Services that are meant to be used by children do not contain external links.

10. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation, if you breach the Terms.

Upon termination, your right to use the Services will immediately cease. The termination will not affect your obligations to us, including any payment obligations to us, and you will not be entitled to a refund of any payments.

If you wish to terminate your account, you may simply discontinue using the Services.

11. Limitation Of Liability

In no event shall Magikbee Lda, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Services; (ii) any conduct or content of any third party on the Services; (iii) any content obtained from the Services; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

12. Disclaimer

Your use of the Services is at your sole risk. The Services are provided on an “AS IS” and “AS AVAILABLE” basis. The Services are provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

Magikbee Lda does not warrant that i) the Services will function uninterrupted, secure, or available at any particular time or location; ii) any errors or defects will be corrected; iii) the Services are free of viruses or other harmful components, or iv) the results of using the Services will meet your requirements.

13. Governing Law

These Terms shall be governed and construed in accordance with the laws of Portugal, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Services, and supersede and replace any prior agreements we might have between us regarding the Services.

14. Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. You agree that any modification on or replacement of these Terms will be effective immediately upon our posting them on the Services. If a revision is material, we will notify you prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Services after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Services.

Any modification to provisions related to fees and billing shall not apply to fees incurred prior to the applicable modification.

1. Acerca de las aplicaciones

KidsBeeTV es una plataforma segura para niños que incluye vídeos y juegos de aprendizaje supervisados por profesores y especialistas en educación, y que está dirigida a niños de entre 1 y 8 años. Nuestras Apps se pueden utilizar en diferentes dispositivos: teléfonos móviles, tabletas y televisores inteligentes.

2. Política de privacidad

El uso de los Servicios está sujeto a nuestra Política de Privacidad. Revise nuestra Política de privacidad, que también rige los Servicios e informa a los usuarios sobre nuestras prácticas de recopilación de datos.

3.1. Cómo funciona en iOS

El pago se cargará a la cuenta de Apple en la confirmación de la compra.
Puede cancelar en línea en cualquier momento, no hay tarifa de cancelación.
Puede utilizar la suscripción en cualquier dispositivo registrado con su cuenta de Apple.
La suscripción se renueva automáticamente, excepto si la renovación automática se desactiva al menos 24 horas antes del final del período actual.
Se cobrará a la cuenta la renovación dentro de las 24 horas que preceden al final del período de facturación actual y se identificará el importe de la renovación.
Las suscripciones pueden ser administradas por el usuario y la renovación automática puede desactivarse yendo a la Configuración de la cuenta del usuario después de la compra.
La cancelación no entrará en vigencia hasta el final del ciclo de facturación.
Cualquier parte no utilizada de un período de prueba gratuito, si se ofrece y cuando corresponda, se perderá cuando el usuario compre una suscripción.

3.2. Cómo funciona en otras plataformas

Las suscripciones se renuevan semanal, mensual o anualmente, según su plan de suscripción.
Su suscripción es válida en cualquier dispositivo registrado en su cuenta KidsBeeTV.
Su suscripción se renueva automáticamente, excepto si deshabilita la renovación automática con al menos 24 horas antes del final del período de facturación actual.
El próximo pago se cobrará 24 horas antes del final del período de facturación actual.

En caso de que se haya suscrito a KidsBeeTV a través de nuestro sitio web o de la galería de aplicaciones de Huawei, contáctenos para administrar su suscripción: support@magikbee.com.
El coste del plan de suscripción actual no se puede reembolsar y el servicio no se puede detener cuando el período de facturación todavía no ha finalizado.
Cualquier prueba gratuita, según corresponda, se interrumpirá cuando se compre una suscripción de pago.
En Android, puede optar por acceder a KidsBeeTV de forma gratuita en una versión basada en anuncios. Todos los anuncios son seguros y aptos para niños.

4. Usuarios Gratuitos o Usuarios sin suscripción

Una parte limitada del contenido de los Servicios estará disponible para los usuarios gratuitos de las Aplicaciones, quienes, para desbloquear cualquier contenido adicional, tendrán que registrarse en el servicio de suscripción. Los usuarios de Android tienen la opción adicional de acceder a todo el contenido en una versión gratuita con anuncios aptos para niños (también llamada “versión AVOD”).

5. Cuenta

Cuando crea una cuenta con nosotros, debe proporcionarnos información que sea precisa, completa y actual en todo momento. El no hacerlo constituye un incumplimiento de los Términos, lo que puede resultar en la cancelación inmediata de su cuenta en nuestros Servicios.

Cada cuenta tiene un usuario adulto designado (“usuario adulto”, “padre” o “tutor legal”) que debe tener al menos 18 años de edad.

Usted es el responsable de salvaguardar la contraseña que usa para acceder a los Servicios y de cualquier actividad o acción realizadas con su contraseña, ya sea que su contraseña sea con nuestros Servicios o con un servicio de terceros.

Usted acepta no revelar su contraseña a ningún tercero. Debe notificarnos inmediatamente si sospecha de cualquier violación de seguridad o uso no autorizado de su cuenta.

6. Contenido

KidsBeeTV es un servicio de transmisión de contenido para niños que también incluye juegos educativos. Todos los programas que se muestran tienen licencia para su distribución dentro de las aplicaciones y son apropiados para la edad para la que han sido designados.

KidsBeeTV se reserva el derecho de modificar el contenido disponible en cualquier momento sin previo aviso.

7. Propiedad intelectual

Los Servicios y todo su contenido, como canciones, vídeos, juegos, actividades, historias, texto, gráficos, obras de arte y las marcas comerciales, logotipos e íconos de botones, características y funcionalidades, son y seguirán siendo propiedad exclusiva de Magikbee Lda y sus Socios de licencias. Los Servicios están protegidos por derechos de autor y otras leyes, tanto de Portugal como de países extranjeros. Usted acepta no copiar, distribuir, vender, almacenar o reutilizar cualquier otro material de los Servicios, a menos que Magikbee le dé permiso expreso por escrito para hacerlo.

8. Quejas de DMCA

Si cree que su trabajo con derechos de autor ha sido copiado de una manera que constituye una infracción de derechos de autor y es accesible a través de nuestros Servicios, notifíquenos, como se establece en la Ley de derechos de autor del milenio digital de 1998 (“DMCA”). 10. Terminación

Podemos rescindir o suspender su cuenta de inmediato, sin previo aviso ni responsabilidad, por cualquier motivo, incluido, entre otros, si incumple los Términos.

Tras la rescisión, su derecho a utilizar los Servicios cesará inmediatamente. La rescisión no afectará sus obligaciones con nosotros, incluidas las obligaciones de pago, y no tendrá derecho a reembolso de ningún tipo.

Si desea cancelar su cuenta, simplemente puede dejar de utilizar los Servicios.

11. Limitación de Responsabilidad

En ningún caso Magikbee Lda, ni sus directores, empleados, socios, agentes, proveedores o afiliados serán responsables de daños indirectos, incidentales, especiales, consecuentes o punitivos, incluidos, entre otros, la pérdida de ganancias, datos, uso, fondo de comercio, u otras pérdidas intangibles, que resulten de (i) su acceso o uso o incapacidad para acceder o usar los Servicios; (ii) cualquier conducta o contenido de cualquier tercero en los Servicios; (iii) cualquier contenido obtenido de los Servicios; y (iv) acceso, uso o alteración no autorizados de sus transmisiones o contenido, ya sea en base a garantía, contrato, agravio (incluida la negligencia) o cualquier otra teoría legal, ya sea que hayamos sido informados o no de la posibilidad de dicho daño, e incluso si se determina que una solución establecida en este documento ha fallado en su propósito esencial.

12. Descargo de Responsabilidad

El uso que realiza de los Servicios es bajo su propio riesgo. Los Servicios se proporcionan “TAL CUAL” y “SEGÚN DISPONIBILIDAD”. Los Servicios se proporcionan sin garantías de ningún tipo, ya sean expresas o implícitas, incluidas, entre otras, garantías implícitas de comerciabilidad, idoneidad para un propósito particular, no infracción o curso de desempeño.

Magikbee Lda no garantiza que i) los Servicios funcionarán de forma ininterrumpida, segura o disponible en cualquier momento o lugar en particular; ii) se corregirán los errores o defectos; iii) los Servicios están libres de virus u otros componentes dañinos, o iv) los resultados del uso de los Servicios cumplirán con sus requisitos.

13. Legislación Aplicable

Estos Términos se regirán e interpretarán en conformidad con las leyes de Portugal, sin tener en cuenta sus disposiciones sobre conflicto de leyes.

Nuestra incapacidad para hacer cumplir cualquier derecho o disposición de estos Términos no se considerará una renuncia a dichos derechos. Si alguna disposición de estos Términos se considera inválida o inaplicable por un tribunal, las disposiciones restantes de estos Términos permanecerán en vigor. 14. Cambios
